Paint & Refinishing Limited Warranty and Disclaimer

Drive By Color LLC - 914 Motor City Drive STE AA2, Colorado Springs, CO 80905

1. Scope & Who’s Covered
   This Limited Warranty applies to paint and refinishing services performed by Drive By Color LLC. (“Drive By Color’s,” “we,” “us,” or “our”) on the vehicle identified above. Coverage applies only to the original vehicle owner named on the Drive By Color’s invoice and is non-transferable.


2. Manufacturer (Parts & Paint Product) Warranty
   Any parts and paint products used in your repair are covered (if at all) exclusively by the respective manufacturer/vendor under their own written warranty terms. All claims for defects in parts or paint materials must be made directly to the respective vendor/manufacturer. Drive By Color will provide invoices and product information to help you start that process, but Drive By Color is not the warrantor for any manufacturer’s products and has no authority to approve or deny manufacturer claims.


3. Drive By Color’s Craftsmanship (Workmanship) Warranty
   Drive By Color’s warrants its craftsmanship in the specific areas we repaired/refinished for the duration stated on your final invoice. This workmanship warranty covers defects in our labor, such as adhesion failure, peeling, blistering, or other finish failures demonstrably caused by improper surface preparation, application, or curing performed by Drive By Color.
   
   Remedy: At our option, Drive By Color will rework, refinish, or touch up the affected area(s). The sole remedy is repair/rework of the affected area; cash refunds are not offered. Warranty service must be performed only at Drive By Color LLC, 914 Motor City Drive STE AA2, Colorado Springs, CO 80905.


4. Not Covered by Any Warranty (Manufacturer or Drive By Color)
   
   

   The following are not covered under any warranty described in this document:

   • Transfer of ownership (warranty is non-transferable).
   • Acts of God (e.g., storms, flood, wildfire, etc.).
   • Collision damage occurring after our repairs.
   • Rock chips or other impact damage.
   • Alterations or modifications of our repairs (including work performed by others after we finish).
   • Neglect (including failure to reasonably maintain/clean).
   • Damage from chemicals (solvents, acids, de-icers, industrial fallout, etc.).
   • Hail.
   • Road hazards (debris, sandblasting, construction zones, etc.).
   • Pollution or environmental fallout/exposure.
   
   

   Note: Nothing in this section limits coverage for an actual defect in Drive By Color craftsmanship as defined above.

   
   
5. When the Warranty Is Void
   

   Drive By Color workmanship warranty is void if any of the following apply to the area of repair:

   • Prior repairs were done before our shop works on the area of repair.
   • Severe contamination is present on/in the substrate of the area of repair (e.g., trapped oil, chemicals, or severe pollution under the paint).
   • Warranty work is not brought back to our shop. Warranty service is only valid if the vehicle is returned to Drive By Color for inspection and remedy. We do not honor our warranty through another shop.


6. How to Make a Warranty Claim
   
   

   For manufacturer/vendor (parts or paint product) claims:

   1. Locate your Drive By Color invoice and any product documentation provided.
   2. Contact the respective manufacturer/vendor per their instructions.
   3. Drive By Color can supply copies of your invoice or material lot info to assist you.
   
   

   For Drive By Color craftsmanship claims:

   1. Contact Drive By Color promptly after noticing an issue and request a warranty inspection.
   2. Bring the vehicle to 914 Motor City Drive STE AA2, Colorado Springs, CO 80905 for evaluation.
   3. If a covered craftsmanship defect is confirmed, Drive By Color will schedule and perform the remedy.
   
   

   Drive By Color is not responsible for towing, storage, rental, ride-share, time off work, loss of use, diminished value, or other incidental or consequential costs associated with a claim or repair.



7. Important Conditions & Limitations
   
   • Inspection required: Drive By Color must inspect the vehicle before any warranty work is approved.
   • One-time remedy per affected area may apply at Drive By Color discretion.
   • Color/time/weather limitations: Normal aging, weathering, fading, or changes in appearance due to environmental exposure or vehicle age are not craftsmanship defects.
   • Maximum liability: To the fullest extent permitted by law, Drive By Color liability is limited to the cost of rework/refinish of the affected area performed at Drive By Color , and excludes incidental, indirect, special, or consequential damages.
   • No implied warranties: To the extent allowed by law, any implied warranties (including merchantability/fitness) are disclaimed or, where disclaimer is not permitted, limited in duration to the workmanship warranty period stated on your invoice.
   • Governing law/venue: This Limited Warranty is governed by the laws of the State of Colorado. Any dispute shall be brought in a court of competent jurisdiction in El Paso County, Colorado.
   • Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
